Privacy Policy of the Break4Movie Platform

1. Objective 

In accordance with the General Data Protection Regulation (GDPR) applicable from May 25, 2018, this document aims to inform the user of the Break4Movie platform about their rights, particularly regarding:

• The collection of their personal data by Break4Movie
• The use of this data
• Access to this data
• The rights the user has on the site
• The policy related to the use of cookies

This privacy policy applies alongside the platform’s terms of use, which the user has also agreed to.

2. Applicable Law 

In accordance with EU Regulation 2016/679 of the European Parliament and of the Council dated April 27, 2016, concerning the protection of natural persons with regard to the processing of personal data and the free movement of such data, the Break4Movie platform intends to specify how it may use the personal information provided by the user. Personal data is:

• Processed lawfully and transparently
• Collected for specified, explicit, and legitimate purposes
• Not processed further in a manner incompatible with those purposes (pursuant to Art. 89 §1 of the General Data Protection Regulation, the storage and processing of data collected for statistical purposes are not considered incompatible with the initial purposes)
• Adequate, relevant, and limited to what is necessary for the purposes for which they are collected
• Accurate and updated at the user’s request (for this purpose, Break4Movie commits to modify or correct any incorrect data provided)
• Stored in a form that allows the identification of the persons concerned for a necessary and sufficient duration to their processing
• Processed in a way that ensures their security, including protection against unauthorized or unlawful processing, accidental loss, destruction, or damage

In this case, the processing of collected data is considered lawful as the user has expressly consented to the collection and processing of said data for at least one of the purposes provided by the regulation. The processing of data is also necessary to the execution of the service contract binding the user to Break4Movie.

3. Consent 

By using the Break4Movie platform, the user expressly consents to all the conditions provided by this privacy policy, as well as the collection, use, and storage of the data listed in this document.

4. Personal Data Collected 

When using the Break4Movie platform, various personal data about the user will be collected.

• Data collected automatically:
  • IP address
  • Geolocation (data used only in case of contract violation)
  • Operating system used
  • Browser used
• The following data is collected non-automatically:
  • Name
  • First name
  • Address
  • Phone number
  • Date of birth
  • Bank details
  • Chosen payment method

            No additional data will be collected without prior notice to the user.

5. Data Processing 

The personal data collected by the Break4Movie platform will only be processed for the purposes specified in this privacy policy.

The platform will create an individualized profile for each user, including all data, to allow their identification and manage the billing of ordered services.

Additionally, suggestions of services will be made based on statistics, particularly on previously ordered services, to offer access to specific content that may meet the user’s wishes.

6. Sharing of Collected Data 

The Break4Movie platform will openly and automatically disclose all collected personal data to its employees, as they need this data to pursue the concluded contract. Collected data will not be shared with third parties outside Break4Movie for any reason. However, personal data may be shared with third parties:

• If Break4Movie is compelled by law
• If the information is required for any legal proceedings
• To protect its own rights (particularly in cases of counterfeiting or hacking – non-exhaustive list)

7. Storage and Protection of Personal Data 

Break4Movie will only keep the data for the time strictly necessary to the fulfillment of the contract and only for the purposes for which it was collected.

8. User Rights and Privileges 

In accordance with Articles 12 to 23 of the General Data Protection Regulation, users of the Break4Movie platform have the following rights and privileges concerning their personal data:

• Right of access (consultation)
• Right to rectification
• Right to erasure
• Right to restrict data processing
• Right to data portability
• Right to object

To exercise the rights mentioned above (access, modification, deletion, etc.), the user can contact the data management service of the platform at the following address: RGPD@Break4Movie.com. Additionally, to ensure compliance with data protection within the organization, a Data Protection Officer (DPO) has been appointed and can be contacted if necessary at the following address: DPO@Break4Movie.com.

9. Cookie Policy 

A cookie is a file stored on the user’s hard drive when browsing a website (including the Break4Movie platform). This cookie helps better understand the user’s browsing habits to maximize their user experience. In accordance with the General Data Protection Regulation, the user can choose to be notified each time a cookie is created or can, if desired, completely disable the transmission of cookies by the platform.

10. Modification of the Privacy Policy 

The Break4Movie platform reserves itself the right to modify this privacy policy, particularly to respond to legislative changes in data protection or the need to adapt the platform’s data management process. If such a modification of the privacy policy becomes necessary for any reason, the user will be informed at least 15 days before the new privacy policy becomes applicable. The user will then have the choice to adhere to this modification or delete their access to the platform.
